U.S. 3rd Circuit Court of Appeals
-----------------------------------------------------------------------
MUNROE v. ASHCROFT (12/16/03 - No. 03-1471)
Although plaintiff was ordered to pay less than $10,000 in restitution
to the victim of his offense, the actual loss to the victim exceeded
$10,000, making plaintiff an "aggravated felon" deportable under the
terms of 8 U.S.C. section 1227(a)(2)(A)(iii). District court properly
denied his petition for writ of habeas corpus.

MUNROE
v. ASHCROFT (12/16/03 - No. 03-1471)
-----------------------------------------------------------------------
U.S. 7th Circuit Court of Appeals
-----------------------------------------------------------------------
TAPIA v. ASHCROFT (12/16/03 - No. 02-2827)
There is substantial evidence to support the immigration court's
conclusion that plaintiff was ineligible for suspension of deportation
because he had not been present in the U.S. for seven consecutive years,
including substantial evidence showing that the Order to Show Cause why
he should not be deported was properly served.

TAPIA
v. ASHCROFT (12/16/03 - No. 02-2827)
BACE v. ASHCROFT (12/18/03 - No. 02-3909)
Any reasonable finder of fact would be compelled to conclude that
plaintiffs, who seek asylum under 8 U.S.C. section 1252(a)(1), were the
victims of past, politically motivated persecution. Thus the government
bears the onus of rebutting the presumptive fear of future persecution.

BACE v.
ASHCROFT (12/18/03 - No. 02-3909)
-----------------------------------------------------------------------
U.S. 9th Circuit Court of Appeals
-----------------------------------------------------------------------
US v. HERNANDEZ-VALDOVINOS (12/17/03 - No. 02-10671)
District court did not err in concluding that Hernandez's prior
conviction was a drug trafficking offense for purposes of U.S.S.G.
section 2L1.2. His two months' incarceration for that offense was a
"sentence imposed" for the purposes of that statute, thus a 12-level
sentencing increase was appropriate.

US v. HERNANDEZ-VALDOVINOS (12/17/03 - No. 02-10671)
WANG v. INS (12/17/03 - No. 02-72176)
Immigration Judge properly denied plaintiff's application for asylum,
pursuant to Immigration and Nationality Act section 208, on grounds that
his documentary and testimonial evidence lacked credibility.

WANG v.
INS (12/17/03 - No. 02-72176)
ARULAMPALAM v. ASHCROFT (12/19/03 - No. 02-71267)
Plaintiff's applications for asylum, withholding of removal, and relief
under the Convention Against Torture were denied by the Immigration
Judge on the basis of an adverse credibility finding. Because
plaintiff's testimony was in fact credible, the matter is remanded.
