ZHANG v. IMMIGRATION AND NATURALIZATION SERV. (11/03/03 - No. 02-1990 )
Petition for review of the Board of Immigration Appeals' order denying
asylum and withholding of removal is dismissed as untimely, and petition
regarding the BIA's subsequent order denying reopening and
reconsideration is denied where petitioners new evidence only
corroborates earlier testimony.

NUNES v. ASHCROFT (11/03/03 - No. 02-55613)
Denial of plaintiff's motion for reconsideration is affirmed where
plaintiff did not 1) present new evidence, 2) identify a change in
controlling law, or 3) identify any clear error; court did not abuse its
discretion when it failed to treat plaintiff's motion as a request for
leave to amend his habeas petition.

AGUILERA-RUIZ v. ASHCROFT (11/04/03 - No. 02-57212)
Habeas relief is denied and the district court is affirmed where, under
8 C.F.R. section 1003.4, any voluntary departure from the US following
entry of an order of deportation will be deemed to withdraw a pending
appeal and to render the order of deportation final.
